Terms
Terms of business
These are the terms that apply when you ask us for an offer and when you sell a vehicle to us. They are written in plain English; if anything is unclear, ask Carlo before your appointment.
Effective from 20 October 2026.
1. Who we are and what these terms cover
Sell Your Car to Caitlin ("we", "us", "our") is a motor trader based at 36 Locks Street, Coatbridge, North Lanarkshire, ML5 3RT. We buy used cars and vans from private sellers and businesses. You can contact us at valuation@sellyourcartocaitlin.com or on 0800 999 1488.
These terms apply when you ask us for an offer on a vehicle and when you sell a vehicle to us. By submitting an enquiry through our website, by WhatsApp, by email or by phone, you agree to these terms. If you do not agree, please do not send us an enquiry.
Nothing in these terms affects any rights you have under the law that cannot be excluded or limited.
2. Definitions
- "Vehicle" means the car or van identified by the registration number in your enquiry.
- "Offer" means the provisional price we communicate to you (usually by email) based on the information and photographs you provide.
- "Appointment" means the meeting at which we inspect the Vehicle, confirm the price and, if agreed, complete the purchase.
- "Completion" means the point at which we and you have agreed the final price, the paperwork has been signed and we have sent payment.
- "Working day" means Monday to Friday excluding Scottish bank holidays.
3. Enquiries and offers
An enquiry is free and places you under no obligation to sell. Equally, an enquiry does not oblige us to make an Offer or to buy the Vehicle. We may decline any enquiry without giving a reason.
Our Offer is provisional. It is based entirely on the information, mileage, condition description and photographs you give us, together with publicly available vehicle data. It is not a valuation of the Vehicle for any other purpose and should not be relied on by anyone else.
An Offer is valid for 5 days from the date it is sent unless we state otherwise. After that it lapses and you may ask us for a new Offer, which may be different.
Used-vehicle prices move. We may withdraw or revise an Offer at any time before Completion, including where market conditions change, where our checks reveal information not disclosed to us, or where we discover an error in the Offer. We will tell you promptly if this happens.
4. What you confirm to us
When you ask for an Offer and when you sell the Vehicle to us, you confirm that:
- you are the legal owner of the Vehicle, or you have the owner's written authority to sell it, and you are at least 18 years old;
- you are the registered keeper shown on the V5C, or you will explain to us why you are not;
- the Vehicle is not subject to any finance, hire-purchase, lease, loan or other agreement that you have not told us about, and no one else has any claim to it;
- the Vehicle is not stolen, cloned, a cut-and-shut, or subject to any police or insurance interest;
- the Vehicle has not been recorded by an insurer as a total loss (write-off category A, B, S or N) unless you have told us;
- the mileage shown is, to the best of your knowledge, genuine and has not been altered;
- the information, condition description and photographs you give us are accurate and complete, and you have told us about any accident damage, mechanical faults, warning lights, outstanding recalls, missing keys or missing documents you know of;
- any private (cherished) registration number you wish to keep will be retained or transferred by you before Completion; and
- you will not use the Vehicle in a way that materially changes its condition between the Offer and the Appointment.
These confirmations matter. We rely on them when we make an Offer and when we pay you. Section 10 explains what happens if any of them turn out to be untrue.
5. The appointment and inspection
If you accept an Offer we will arrange an Appointment, normally at our premises during our published hours. Appointments usually take around 30 minutes.
At the Appointment we will inspect the Vehicle, which may include a short test drive, checking the paperwork and running identity and vehicle-history checks (see section 7). If the Vehicle, its history or its documents are as you described, we will confirm the Offer as the final price.
If the Vehicle differs materially from your description, or our checks show something not disclosed to us, we may make a revised offer or decline to buy. You are free to refuse a revised offer and leave with the Vehicle. There is no charge for an inspection whether or not a sale goes ahead.
Please bring: the V5C registration certificate (logbook); all keys; the service history and any receipts; the MOT certificate if you have it; photo identification (passport or driving licence) and proof of address dated within the last three months; and, if there is finance outstanding, an in-date settlement letter from the finance company.
6. Agreeing the sale
A binding contract for the sale of the Vehicle is formed only when, at or after the Appointment, we and you have agreed the final price and both signed our purchase invoice or receipt. Until then either of us may walk away without liability to the other.
We may decline to proceed at any time before Completion for any lawful reason, including where our identity, finance or vehicle-history checks are not satisfactory, where we are unable to verify your bank account, or where we reasonably suspect fraud.
7. Identity, finance and vehicle-history checks
To protect you, us and the Vehicle's previous and future owners, we may check the Vehicle's history (including finance, theft, write-off, mileage and identity records) with the DVLA and with recognised vehicle-data providers, and we may verify your identity and address against the documents you bring. We do not buy vehicles where these checks cannot be completed satisfactorily.
We keep records of these checks for as long as the law and our insurers require. See our privacy notice for details.
8. Price and payment
We pay the agreed price by electronic bank transfer to a UK bank account in your name (or, for a business seller, in the business's name). We do not pay cash. Payment is sent on the same working day as Completion; most transfers arrive within minutes, but we are not responsible for delays caused by banks.
We charge no administration, transaction or same-day payment fees.
If there is finance outstanding on the Vehicle, we will pay the settlement figure shown on the finance company's in-date settlement letter directly to the finance company and pay the balance to you. If the settlement figure is higher than the agreed price, you must pay us the difference, in cleared funds, before Completion. We may ask the finance company to confirm the settlement and may delay Completion until it does.
The agreed price is the full amount we will pay. It is inclusive of everything and you are not entitled to any further sum, for example for fuel, accessories or remaining road tax (which the DVLA refunds to you directly once the sale is notified).
9. Documents, DVLA and handover
At Completion you will hand over the Vehicle, all keys and the documents listed in section 5. You will complete and sign the "sold to a motor trader" section of the V5C (or confirm the sale online with the DVLA) so that the DVLA's records are updated. We will give you a written receipt. Until the DVLA has been notified you remain the registered keeper, so please do this at the Appointment or on the same day; we will help you do it.
You are responsible for removing any personal belongings, child seats, dash cams and private registration plates before handover. We may dispose of anything left in the Vehicle after 14 days unless you have asked us to keep it.
You must keep the Vehicle insured until Completion. After Completion you should cancel your insurance and any breakdown cover; we are not responsible for any premiums you continue to pay.
10. Ownership, risk and misdescription
Ownership of and risk in the Vehicle pass to us at Completion, when we have sent payment. Before that point the Vehicle remains yours and at your risk, including during any test drive, except for damage caused by our negligence.
If, after Completion, we discover that any confirmation you gave under section 4 was untrue, or that the Vehicle was materially misdescribed (for example undisclosed finance, an undisclosed write-off record, an incorrect mileage, a cloned identity or a defect you knew about and did not tell us), then you agree to pay us, within 14 days of our written request, the difference between the price we paid and the Vehicle's true value, together with any sums we have had to pay to a third party (such as a finance company) as a result, and our reasonable costs. Where the Vehicle turns out not to have been yours to sell, or is recovered from us by a third party, you agree to repay the full price. This does not affect any other remedy available to us in law.
Our rights under this section last for five years from Completion, in line with the Prescription and Limitation (Scotland) Act 1973.
11. Collection
Where a Vehicle cannot safely be driven, we may offer to collect it. Collection is at our discretion and on the terms we agree with you in writing beforehand, including where and when it takes place and whether any deduction from the price applies. The Appointment, inspection and Completion steps in these terms apply on collection in the same way as at our premises.
12. Our responsibility to you
If we fail to comply with these terms we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for loss that is not foreseeable, for loss of profit or business, or for loss caused by events outside our reasonable control.
Our total liability to you in connection with any Vehicle is limited to the price we agreed to pay for it.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
13. Cancelling
Before Completion you may withdraw from the sale at any time without charge, and so may we (see sections 3 and 6).
Once Completion has taken place the sale is final and cannot be cancelled by either of us. Because you are selling to us rather than buying from us, the consumer cancellation rights that apply to purchases made at a distance do not apply to this contract.
14. Complaints
If something has gone wrong, please tell us at valuation@sellyourcartocaitlin.com or on 0800 999 1488. We aim to acknowledge complaints within two working days and to resolve them within 14 days.
15. General
- These terms, our purchase invoice or receipt, and our privacy notice are the whole agreement between us about the Vehicle. Anything said during an enquiry or Appointment that is not written into them does not form part of the contract, unless it was a misrepresentation.
- We may transfer our rights under these terms to another business; you may not transfer yours without our written consent.
- If a court finds any part of these terms unenforceable, the rest will continue to apply.
- If we delay in enforcing these terms we can still enforce them later.
- We may update these terms from time to time. The version in force when you make your enquiry applies to that enquiry.
- These terms are governed by the law of Scotland. Any dispute will be dealt with by the Scottish courts. If you live elsewhere in the United Kingdom you may also bring proceedings in your local courts.
